Miranda – Custodial reapproach after the right to counsel was invoked.
The Supreme Court affirmed the judgment of the circuit court convicting Defendant of two counts of rape, one count of kidnapping, and other offenses, holding the circuit court properly denied Defendant’s motion to suppress his custodial statement. The officer informed Rickman that if he wanted to talk to them, he would have to sign a written form, to which Rickman responded he would rather just go ahead and get it over with and talk to the officer.” The officer’s statement did not amount to a reapproach and Rickman initiated the discussion of changing his mind and talking to the officers without counsel present.
